Brad Alcorn, Special Counsel at Fee Langstone
Brad will discuss bullying and harassment in the workplace and the current approach employed by WorkSafe. He will discuss examples of WorkSafe’s investigations of bullying and harassment as well as investigations and prosecutions undertaken by WorkSafe’s equivalents in other jurisdictions.

Ellie Harrison, Senior Associate at Wynn Williams
Looking at two trials concerning corporate recklessness in the health and safety context (one successful; one unsuccessful although under appeal), Ellie will cover the regulators’ approaches, judicial decisions and implications for underwriters.

Edwin Boshier, Senior Associate at Duncan Cotterill
Edwin will discuss the increasing pressures that prosecutions under the Health and Safety at Work Act are putting on statutory liability policies, and some issues to which insurers need to be alert. He will take us through the recent Ocean Fisheries case, discuss the prospect of director and officer charges becoming more common, and look at some cases which suggest an increasing willingness of defendants to resist charges or to seek alternatives to the more orthodox sentence of a conviction and fine. All of these have implications for insurers, with liability limits and certain exclusions becoming increasingly relevant.

What will become of the RMA? A discussion on what’s not working and what is proposed to fix it

The Resource Management Act has long been known as an unwieldy piece of legislation and piecemeal attempts at improvement have not helped to achieve it’s purpose.
Two speakers who are very familiar with the issues presented by the RMA.
Firstly, former Court of Appeal Judge Tony Randerson QC and chair of the Resource Management Review Panel will provide his views on the proposed reforms and the legislation intended to replace the RMA.
Then Patrick Lynch, Waikato Regional Council’s Manager – Regional Compliance, will share some examples of the practical difficulties of trying to enforce compliance with the RMA.

Power and money in civil litigation
Civil justice reform is attempting to rebalance access to justice, acknowledging that players in the system have unequal access to power and money. Reforms include reviewing class actions and litigation funding, increasing judicial control of proceedings, initiatives to assist litigants in person (including increasing the jurisdiction of lawyer-less forums like the Disputes Tribunal), and developing specialist jurisdictions to deal with areas creating large numbers of claims. This session will explore these reforms, ask whether they can achieve their aims, and what it might mean for those practicing in the field of insurance law.

Dr Bridgette Toy-Cronin is a Director and Senior Lecturer at the University of Otago Faculty of Law.
